April 21, 2009—Both the House and the Senate were paralyzed by constant filibustering, which resulted in a relatively uneventful week in the Legislature.  However, one hot topic was Rep. McLaughlin’s unitary combined reporting proposal (HB 865), which would require combined reporting for multistate corporations and would repeal the existing consolidated return regime.  The bill has received staunch opposition from multistate businesses, as well as the influential Business Association Tax Coalition (“BATC”), which has asked for a public hearing on the bill.  Both the Council On State Taxation (“COST”) and the Organization for International Investment have submitted letters to Rep. McLaughlin expressing their opposition to HB 865. At this time, the bill, which has been assigned to the House Education Appropriations Committee, has not been scheduled for committee consideration.
