New Federal and State Legislation
Provide Tax Incentives to Promote
Job Creation
This Spring, both Congress and the Alabama Legislature passed bills
designed to promote job creation. Both the “Hiring Incentives to Restore
Employment Act” (the “HIRE Act,” Public Law 111-147) and the “Reemployment
Act of 2010” (Alabama Act 2010-557) provide tax incentives for businesses that
hire unemployed workers. On March 18, 2010, President Obama signed the
HIRE Act into law. The HIRE Act encourages companies to hire unemployed
workers by exempting certain wages from Social Security taxes (payroll tax
exemption), and by providing employers with a business tax credit if they retain
the new hires for at least 52 consecutive weeks. Similarly, the Reemployment
Act of 2010, which Governor Riley signed last week, is designed to create
jobs by providing an income tax deduction to businesses that hire certain
unemployed persons. Each incentive is summarized in the full article.

The Alabama Legislature adjourned sine die on Thursday, April 22, concluding a relatively
productive, though often contentious, 2010 Regular Session. Unlike most years, when the session ends amidst a last-minute rush to pass the two main operating budgets, the budgets passed relatively early this year and without any tax increases, primarily as a result of federal stimulus funds and significant belt-tightening. Without budgets to debate during its last two meeting days, the Legislature passed the proposed $1 billion road and bridge construction constitutional amendment and the Prepaid Affordable College Tuition (PACT) bail-out plan during its final days.
While the Legislature passed over 300 bills during this last session of the 2006-2010 quadrennium, many critical measures such as ethics reform, constitutional reform and restrictions on PAC-to-PAC transfers were not addressed this session, and only a handful of tax bills made it across the finish line. Next session, however, promises to be more dicey. Unless the revenue forecasts improve dramatically, we expect to see a variety of revenue raisers (or so they say), such as mandatory unitary combined reporting, introduced next session.

Being Healthy Can Be Good for Your Wallet
Now that the weather is getting nicer, many gyms and health clubs are offering membership specials and discounts to attract new members. Some health clubs offer benefit packages, such as discounts for cell phone service or car rentals. If you were considering joining a gym, now could be an ideal time to do so! Just make sure you read the fine print before joining—is your obligation for a month, a year or more? Will you be automatically renewed after the obligation?
